Know Your Rights!

If you are stopped, questioned, searched, or arrested by law enforcement, it is very important that you know your rights. Everyone is entitled to basic, constitutional rights and you should immediately contact an attorney if you feel that they have been violated.

You are not obligated to answer any questions if you are stopped on the street by law enforcement. Inform them that you do not wish to talk and then ask them if you are free to go. Calmly walk away if the officer says yes, but never run. If you are not free to go, ask if you are being arrested. If the answer is no, then you are being detained. If the officer believes that you are armed or dangerous, he/she can pat down the outside of your clothes while you are being detained. However, your consent if required for them to search your further. If they search you any further without your consent, do not physically resist. Even if you are arrested or detained, you still do not have to answer any questions but you may be required to give the officer your name depending on which state you are in.

If you are pulled over by law enforcement when you are in your car, it is important to keep your hands where the officer can seem them. Show the officer your drivers license, registration, and proof of insurance when he asks. You are not obligated to answer any questions but you may be asked to step out of the car. Unless there is probable cause that criminal activity has taken place, your car cannot be searched without your consent. So if you do not want your car searched, do not give consent. The officer does not have grounds to search your vehicle just because you refuse consent.

If you are arrested, the officer must tell you the offense you are being charged with and must advise you of your Constitutional rights such as the right to remain silent, the right to an attorney, or the right to an appointed attorney if you cannot afford one.
